Recursis, Inc. (“Recursis”) is a company offering professional services to customers on a global basis. We are serving present and future customers in the EU and in the United States. Privacy laws and regulations differ in every jurisdiction. Most importantly, your privacy, no matter who you are and no matter where you live, is important to Recursis.

So we’ve developed a Privacy Policy that covers how we collect, use, disclose, transfer, and store your personal information that we collect when you visit our website or engage in business with us in whatever country you live or work in.

What follows is more detail about our policies regarding privacy. Please take a moment to familiarize yourself with our privacy practices and contact us if you have any questions.

Collection and Use of Personal Information

Personal information is data that can be used to identify or contact a single person.

You may be asked to provide your personal information when you are in contact with Recursis or a Recursis affiliated company. Recursis and its affiliates (i.e., companies that are legal subsidiaries of Recursis), may share this personal information with each other and use it consistent with this Privacy Policy. Recursis may also combine personal information with other information to provide and improve our project service offerings, marketing content, and advertising.

You are not required to provide any personal information that we request, but, if you chose not to do so, in many cases we will not be able to provide you with our professional services or respond to any queries you may have.

Here are some examples of the types of personal information Recursis may collect and how we may use it:

What personal information we collect

When you contact Recursis for information about our professional services offerings, for example, we may collect a variety of information, including your name, mailing address, phone number, email address, contact preferences, device identifiers, IP address, or geographic location information. This is done so that we can get in contact with you. This is also done as part of an effort to eventually help you create the best outcomes on data projects and create world leading data solutions with you and your organization.

How we use your personal information

As mentioned above, we may process your personal information for the purposes described in this Privacy Policy, with your consent, for compliance with a legal obligation to which Recursis is subject, or when we have assessed it is necessary for the purposes of the legitimate interests pursued by Recursis or a third party to whom it may be necessary to disclose information. We take these situations seriously. We will do everything in our power to hold your information private according to this Privacy Policy, but if the law is after your information and there is a legitimate legal request to share your information, we will provide it in accordance with the jurisdiction and laws that the situation calls for.

The personal information we collect allows us to keep you posted on Recursis service offerings, product announcements, information updates, and upcoming events such as conferences, meetups, or speaking engagements. We also use personal information to help us create, develop, operate, deliver, and improve our professional service offerings, our content and advertising.

We may use your personal information to determine appropriate services to offer.

From time to time, we may use your personal information to send important notices, such as communications about purchases and changes to our terms, conditions, and policies. Because this information is important to your interaction with Recursis, you may not opt out of receiving these communications.

We may also use personal information for internal purposes such as auditing, data analysis, and research to improve Recursis’s products, services, and customer communications.

Source of your personal information where they are not collected from you

We may have received your personal information from other persons if that person has shared Recursis advertising, marketing content, website links, marketing ,or has invited you to participate in Recursis meetups, user group meetings, or other forums.

Collection and Use of Non-Personal Information

We also collect data in a form that does not, on its own, permit direct association with any specific individual. We may collect, use, transfer, and disclose non-personal information for any purpose. The following are some examples of non-personal information that we collect and how we may use it:

  • We may collect information such as occupation, language, zip code, area code, unique device identifier, referrer URL, location, and the time zone where an Recursis service implementation is used so that we can better understand customer behavior and improve our professional services and advertising.

 

  • We may collect information regarding customer activities on our website and from our other service engagements with you. This information is aggregated and used to help us provide more useful information to our customers and to understand which parts of our website and professional services are of most interest. Aggregated data is considered non‑personal information for the purposes of this Privacy Policy.
  • We may collect and store details of how you use our services, including search queries. This information may be used to improve the relevancy of results provided by our services and information on our website. Except in limited instances to ensure quality of our services over the Internet, such information will not be associated with your IP address.

If we do combine non-personal information with personal information the combined information will be treated as personal information for as long as it remains combined.

Cookies and Other Technologies

Recursis’s website, any interactive applications used for demonstrating proof of concepts or software prototypes, email messages, and advertisements may use “cookies” and other technologies such as pixel tags and web beacons. These technologies help us better understand of our current and potential customers and their user behavior on parts of our website that they have visited, and facilitate and measure the effectiveness of advertisements and web searches we may employ. We treat information collected by cookies and other technologies as non‑personal information. However, to the extent that Internet Protocol (IP) addresses or similar identifiers are considered personal information by local law, we also treat these identifiers as personal information. Similarly, to the extent that non-personal information is combined with personal information, we treat the combined information as personal information for the purposes of this Privacy Policy. Recursis also use cookies and other technologies to remember personal information when you use our website.

If you want to disable cookies you can do this in any modern web browser in the the privacy pane to manage your preferences. Please note that certain features of the Recursis website may not be available once cookies are disabled.

As is true of most internet services, we gather some information automatically and store it in log files. This information includes Internet Protocol (IP) addresses, browser type and language, Internet service provider (ISP), referring and exit websites and applications, operating system, date/time stamp, and clickstream data.

We use this information to understand and analyze trends, to administer the site, to learn about user behavior on the site, to improve our product and services, and to gather demographic information about our user base as a whole. Recursis may use this information in our marketing and advertising that we do.

In some of our email messages, we use a “click-through URL” linked to content on the Recursis website. When visitors or customers click one of these URLs, they pass through a separate web server before arriving at the destination page on our website. We track this click-through data to help us determine interest in particular topics and measure the effectiveness of our customer communications. If you prefer not to be tracked in this way, you should not click text or graphic links in the email messages.

Pixel tags enable us to send email messages in a format customers can read, and they tell us whether mail has been opened. We may use this information to reduce or eliminate messages sent to customers.

Disclosure to Third Parties

At times Recursis may make certain personal information available to partners or subcontractors that work with Recursis and provide professional services directly to your organization. For example, personal information will only be shared by Recursis to improve or to directly deliver the agreed professional services in the scope of a paid professional services engagement or data project. Recursis will never share personal information with third parties for their marketing purposes.

Service Providers

Recursis shares personal information with companies who provide services such as information processing, extending credit, fulfilling customer orders, delivering products to you, managing and enhancing customer data, providing customer service, assessing your interest in our products and services, and conducting customer research or satisfaction surveys. These companies are obligated to protect your information and may be located wherever Recursis operates.

Others

It may be necessary − by law, legal process, litigation, and/or requests from public and governmental authorities within or outside your country of residence − for Recursis to disclose your personal information. We may also disclose information about you if we determine that for purposes of national security, law enforcement, or other issues of public importance, disclosure is necessary or appropriate.

We may also disclose information about you if we determine that disclosure is reasonably necessary to enforce our terms and conditions or protect our operations, customers, or users. Additionally, in the event of a reorganization, merger, or sale we may transfer any and all personal information we collect to the relevant third party.

Protection of Personal Information

Recursis takes the security of your personal information very seriously. Recursis online services such as the Recursis website protect your personal information during transit using encryption such as Transport Layer Security (TLS). When your personal data is stored by Recursis, we use computer systems with limited access housed in facilities using physical security measures. Data is stored in encrypted form including when we utilize third-party storage.

When you use the Recursis website or post Recursis linked content to a social networking service, the personal information and content you share is visible to other users and can be read, collected, or used by them. You are responsible for the personal information you choose to share in these instances.

Automated Decision-Making and profiling

Recursis does not make any decisions based on the use of algorithms or data generated from automated profiling.

Integrity and Retention of Personal Information

Recursis makes it easy for you to remove your information from our systems. Send us an email, and we will remove your personal information from our system. We will retain your personal information for the period necessary to fulfill the purposes outlined in this Privacy Policy and our service specific privacy summaries. When assessing these periods we carefully examine our need to collect personal information at all and if we establish a relevant need we only retain it for the shortest possible period to realize the purpose of collection unless a longer retention period is required by law.

Access to Personal Information

You can help ensure that your contact information and preferences are accurate, complete, and up to date by keeping us informed. Just send an email to us and we can provide you with the current details and update your information in our system if necessary. For other personal information we hold, we will provide you with access (including a copy) for any purpose including to request that we correct the data if it is inaccurate or delete the data if Recursis is not required to retain it by law or for legitimate business purposes. We may decline to process requests that are frivolous/vexatious, jeopardize the privacy of others, are extremely impractical, or for which access is not otherwise required by local law. We may also decline aspects of deletion or access requests if we believe doing so would undermine our legitimate use of data for anti-fraud and security purposes.

Children & Education

Recursis believes that children and education are the key to a bright future when it comes to technology and software. At Recursis, we dedicate a percentage of our profits and time each year to charities that help underprivileged children gain opportunities to learn how to use technology and how to code.

We also understand the importance of taking extra precautions to protect the privacy and safety of children using Recursis’s website. If we learn that we have collected the personal information of a child under 16, or equivalent minimum age depending on jurisdiction, outside the above circumstances we will take steps to delete the information as soon as possible.

If at any time a parent needs to access, correct, or delete data associated with their child or a minor in their guardianship, they may contact us directly.

Location-Based Services

Location data is collected anonymously based on IP addresses on the Recursis website in a form that does not personally identify you and is used by Recursis to improve our professional service offerings and regional marketing of the messages.

Third‑Party Sites and Services

The Recursis website may contain links to third-party websites, products, and services. Our services may also use or offer products or services from third parties − for example, a third‑party cloud vendor data integration component, or a cloud storage system, or an open source project toolkit.

Information collected by third parties, which may include such things is governed by their privacy practices. We encourage you to learn about the privacy practices of those third parties.

California (USA) Privacy Disclosures

Do Not Track – Recursis does not track its customers over time and across third party websites to provide targeted advertising and therefore does not respond to Do Not Track (DNT) signals. However, some third party sites do keep track of your browsing activities when they serve you content, which enables them to tailor what they present to you. If you are visiting such sites, you can set modern browsers so that third parties (particularly advertisers) know you do not want to be tracked. Find out more by reading about security and privacy settings in the browser that you use on your devices. 

Third parties that have content embedded on the Recursis website such as a social feature may set cookies on a user’s browser and/or obtain information about the fact that a web browser visited a specific Recursis website or page from a certain IP address. Third parties cannot collect any other personally identifiable information from Recursis’s website unless you provide it to them directly.

EU-U.S. Privacy Shield Framework

Recursis complies with the EU-U.S. Privacy Shield Framework and Swiss-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union and Switzerland to the United States.  Recursis has certified to the Department of Commerce that it adheres to the Privacy Shield Principles. If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. Our Privacy Policy describes how we use personal information we receive from different sources. This Privacy Shield Policy describes how we process personal information covered by the Privacy Shield.

As stated in this Privacy Policy, your personal information is kept strictly confidential and will not be shared or sold to third parties except as necessary to deliver our services. In the event Recursis will need to share information outside of our normal services, we will offer individuals the opportunity to choose (opt-out) whether their personal information is (a) to be disclosed to a third party acting as a controller, or (b) to be used for a purpose that is materially different from the purpose for which it was originally collected or subsequently authorized by the individual. Recursis will provide individuals with reasonable and readily available mechanisms to exercise their choices.

Where Recursis collects personal information directly from our clients’ customers in the European Union and Switzerland, it will inform those individuals about the purposes for which it collects and uses personal information about them; the types or identity of third parties acting as controllers to which Recursis discloses that information, the purposes for which it does so, and the choices and means Recursis offers individuals for limiting the use and disclosure of their personal information, and about the right of individuals to access their personal data. Notice will be provided in clear and conspicuous language when individuals are first asked to provide personal information to Recursis, or as soon as practicable thereafter, and in any event before Recursis uses the information for a purpose other than that for which it was originally collected or discloses it for the first time to a third party.

In compliance with the Privacy Shield Principles, Recursis commits to resolve complaints about our collection or use of your personal information.  EU and Swiss individuals with inquiries or complaints regarding our Privacy Shield policy should first contact Recursis’s Data Protection Officer, a company director at Recursis, Inc. located at Hohe Winde Strasse 52, CH-4059 Basel, Switzerland. In the event that your personal information is covered by the EU-US Privacy Shield Framework, you may also contact the data controller by mail at this address or email at info@recursis.com.

Recursis has further committed to refer unresolved Privacy Shield complaints to JAMS, an alternative dispute resolution provider located in the United States. If you do not receive timely acknowledgment of your complaint from us, or if we have not addressed your complaint to your satisfaction, please contact or visit JAMS for more information or to file a complaint.  The services of JAMS are provided at no cost to you.

Furthermore, individuals have the possibility, under certain conditions, to invoke binding arbitration for complaints regarding Privacy Shield compliance not resolved by any of the other Privacy Shield mechanisms. For additional information, please refer to Annex I of the Privacy Shield Framework.

In the context of an onward transfer, Recursis has responsibility for the processing of personal information it receives under the Privacy Shield and subsequently transfers to a third party acting as an agent on its behalf. Depending on the circumstances, Recursis may remain liable under the Privacy Shield if its agent processes such personal information in a manner inconsistent with the Principles.

Under the EU-U.S. Privacy Shield Framework, the Federal Trade Commission has jurisdiction over Recursis’s compliance with the Framework.

To make sure your personal information is secure, we communicate our privacy and security guidelines to all Recursis employees and strictly enforce privacy safeguards within the company.

When a privacy question or question about personal information received in response to an access/download request is received we have a dedicated team which triages the contacts and seeks to address the specific concern or query which you are seeking to raise. Where your issue may be more substantive in nature, more information may be sought from you. All such substantive contacts receive a response. If you are unsatisfied with the reply received, you may refer your complaint to the relevant regulator in your jurisdiction. If you ask us, we will endeavor to provide you with information about relevant complaint avenues which may be applicable to your circumstances.

Recursis may update its Privacy Policy from time to time. When we change the policy in a material way, a notice will be posted on our website along with the updated Privacy Policy.
